General Title Risk
An investor specializing in large tracts of forestland purchased title insurance for its first foray into South America. The transaction was on a tight time schedule. FNF International sent one of its senior underwriting attorneys to the local law firm providing diligence in order to close the transaction as quickly as possible. Title insurance provided the investment fund with the comfort they needed to close a transaction in a foreign jurisdiction. Our ability to act quickly in the face of a tight time schedule facilitated closing to the advantage of our Insured.
Defined Risk Title Insurance Transaction
A European investor with fiduciary obligations was purchasing a “Class A” building in South America. The purchaser discovered a potential defect in an easement in part of the underground parking and storage, which could potentially annul the right to use and access the underground. Title insurance was the only way to mitigate this specific risk and ultimately close the transaction.
