The Fidelity National Title underwriters backing FNF Title International provide responsive support to customers initiating a claim. Claims are settled according to the conditions and stipulations of the title insurance policy, and paid within 30 days once the liability and extent of damage have been fixed, pursuant to the policy.

Restrictive Covenant Claim UK:
Indemnify for Loss

•       A developer negotiated the £2.5 million purchase of land for construction of a multi-family project.

•       The developer’s solicitor advised that there was an ancient restrictive covenant on the land, limiting it to single family use.

•       The solicitor advised that the likelihood that a beneficiary of the covenant would emerge to challenge the development was extremely remote, and the underwriter issued a legal indemnity policy covering the risk.

•       A beneficiary did emerge, insisted on strict adherence to the covenant, refused settlement, and the underwriter indemnified the developer for the loss of its entire investment.
